The woman was employed at the housing offer Sødisbakke in Mariager, but the violence took place during a hospitalization of the resident at a hospital on Zealand. The woman hit the resident with a flat hand in the face, causing the blush on her left cheek.
The indictment was filed as violence in particularly aggravating circumstances because the woman took advantage of the victim’s defenseless position, and she has been convicted in full, prosecutor Ulrik Birk says.
He had demanded a prison sentence of four months and emphasizes that the resident was completely defenseless.
– It is very serious when you do it against defenseless victims. You are entrusted with a resident who is in a completely defenseless position.
– Then it is very aggravating that you use that power to beat the person. It is a person who has no language and has no opportunity to say it afterwards, says Ulrik Birk.
The woman has pleaded not guilty during the case. Prior to the case, she spoke to Randers Amts Avis.
– We all try, individually, to provide our best educational work in any situation. I have not done anything with an evil or bad intention, and I am therefore in no doubt at all about my pedagogical professionalism and person.
– I have not been convicted and no one really knows what happened. I judge that I tried to act in my best opinion, and we are only people where we can all go wrong, she wrote to the newspaper.
She also pointed out that she lacked the tools on the part of management to handle tasks like this.
The woman has taken time to consider whether she will appeal the verdict to the high court. It is also an option for the prosecution to appeal if it wants to go for a harsher sentence.
