On Wednesday, the 22-year-old motorist at the Court in Kolding was sentenced to one year and four months unconditional imprisonment for negligent manslaughter. In addition, he has been disqualified from driving for five years.
This is stated by special prosecutor Pernille Moesborg.
– He was convicted of overtaking in dense fog and that it was particularly reckless driving. And that he had thereby negligently caused the young man’s death, and that it was in particularly aggravating circumstances, she says.
The man pleaded guilty to negligent manslaughter, but he denied that it was in particularly aggravating circumstances. Nor did he think it was reckless driving.
The man has explained in court that he was not overtaking, but that there was something on the road that he wanted to dodge, and that he therefore ended up in the opposite lane.
The special prosecutor argued in court that it should cost the 22-year-old between one and a half years in prison and one year and nine months in prison.
The entire sentence is unconditional, which means the 22-year-old must serve it.
The man has not been convicted of anything like this before and he has good personal relationships. It can typically speak for a conditional or partial conditional sentence
In this type of case, however, according to Pernille Moesborg, it is common to give unconditional penalties.
– It also shows that this is something that is taken very seriously, she says.
The 22-year-old must pay 75,000 kroner to each of the boy’s parents, and in addition he must pay 45,000 kroner to cover the cost of the boy’s funeral.
He is considering whether to appeal the verdict to the high court.
