The Code of Judicial Procedure states that the police must first have a permit from a judge if they want to monitor a place that is not freely accessible. But it did not happen.
The case appears from an access to documents that Ritzau has received from the Ministry of Justice. The courts must send reports when they discover that so-called coercive interventions have not been in order.
The special group Special Investigation West has been responsible for the investigation.
It was November 4 and November 11 last year that officers set up automatic cameras at the site.
About the course of events, a prosecutor writes to the court:
“This happened without prior legal assessment, but only on the basis of a police professional estimate. On 17 November 2020, the undersigned became aware that cameras had been set up without prior order from the court at the address, and these were subsequently switched off immediately”.
In the letter, there is also an apology from the prosecutor.
The judge was then presented with the case. First, she found that the intervention had been illegal. And then she said – after assessing police material – good for future surveillance for four weeks.
Annually, the Ministry of Justice receives between 10 and 20 reports of interventions that have been outside the dial.
Some cases involve interfering with incorrect telephone numbers due to typing errors. Other times, the police have had access to telecommunications information for a longer period than was permitted.
In the specific case of the cigarettes, the police suspected that people from Ukraine and Poland were manning the illegal factory. With video cameras, officers wanted to record what was going on around the property and see who was coming and going.
The case is pretty extensive. In March this year, 13 men from Poland and Ukraine were remanded in custody.
At the factory in Vamdrup, at least 45 million cigarettes were produced, and in this way the treasury has been cheated for almost 80 million kroner, according to the charges.
European police cooperation Europol has stated that the smokers were going to the UK via the Netherlands.
